CP Group affiliate Asia Era One has formally sought to end its contract for the three-airport high-speed rail project, citing obstacles to securing investment promotion and financing, the State Railway of Thailand (SRT) said on Thursday.
SRT Governor Anan Phonimdaeng said the concessionaire submitted a letter on July 6 seeking to exercise its termination right under Clause 6.2 of the contract. Asia Era One said it could not meet conditions related to Board of Investment promotion or proceed toward a notice to proceed, adding that the lack of BOI approval affected its ability to secure loans from financial institutions.
The move followed a June 24 meeting between SRT, the Eastern Economic Corridor Office and Asia Era One that narrowed the way forward to two options: proceed with previously proposed contract amendments or consider ending the agreement. The Office of the Attorney General has completed its review of the revised contract, and Asia Era One has accepted all 18 observations raised during the process, but the amendments still require further consideration by the EEC Policy Committee and Cabinet.
Anan said SRT would first pursue the contract amendment route. If that fails and Asia Era One maintains that it cannot proceed, the railway agency would then consider termination. SRT is also preparing contingency plans for the Airport Rail Link because Asia Era One’s operating rights are tied to the main contract and the current operating MOU expires on Sept 30. Options include extending the MOU with the company or having SRT resume operations to prevent disruption to passengers.
