Thai Government issues new rule which allows state agencies to terminate contractors over deadly accidents

The government has issued a new ministerial regulation allowing state agencies to terminate contracts with contractors whose work causes death, injury or serious damage to public property by classifying such incidents as “contract abandonment.”
Opposition People’s Party Bangkok MP Suphanat Minchaiynunt said the regulation, published in the Royal Gazette on July 23, closes a loophole in the 2017 Public Procurement Act, which previously did not allow fatal construction accidents to be used as grounds for terminating contracts.
Suphanat said the loophole became apparent after a railway bridge beam collapse in Sikhiu district, Nakhon Ratchasima, killed 32 people. Although the prime minister ordered the contract cancelled, the government was unable to do so because there were no clear legal grounds.
Under the new regulation, contractors responsible for serious accidents can have their contracts terminated immediately and be blacklisted by the Comptroller General’s Department. Suphanat said the measure is separate from the contractor performance scorecard system, which only affects future bidding and does not require ongoing contracts to be cancelled.
