90-day deadline set for legal dispute over the 6-billion-baht Ashton Asoke condominium project in Bangkok
A solution to a legal dispute over the 6-billion-baht Ashton Asoke condominium project in the Watthana district of Bangkok needs to be found in three months, according to a court official.
This comes amid concerns the condo could be demolished if no solution is found and follows a Supreme Administrative Court order last July revoking the condo’s building permit because the property’s main entrance was not the required width.
The court invalidated the construction permit granted to the already finished condominium project as the permit was issued unlawfully.
The condo’s main entrance is connected to Asoke Road but part of the entrance belongs to the Mass Rapid Transit Authority (MRTA), which expropriated the land to build the entrance to an underground train station right on the project’s doorstep.
Prawit Boonthiem, president of the Supreme Administrative Court’s tort and other liabilities section, on Thursday said the Bangkok Metropolitan Administration (BMA), Ananda MF Asia Asoke Co, and the MRTA have three months to solve the problem in accordance with the Building Control Act. If the responsible agencies fail to do so within the deadline, the BMA must invoke the act, which requires the building to be demolished. The window for demolition is 90 days, Mr Prawit said.
Bangkok deputy governor Wisanu Subsompon expressed confidence a solution will be reached in three months as the developer has been advised to re-submit a request for a construction permit without first having to take down the building. A panel has also been formed by the Transport Ministry, and meetings will be held to set guidelines for the MRTA to resolve the land expropriation issue, he said.
