Legal ruling sought on terminating Italian-Thai Development Plc (ITD) contracts on Thai-Chinese high-speed rail project
Rail project could face lengthy delay
The State Railway of Thailand (SRT) will seek a final ruling from the Attorney-General on whether to terminate contracts with Italian-Thai Development Plc (ITD) following a deadly rail accident.
Anan Phonimdaeng, acting SRT governor, said yesterday the SRT board on Thursday agreed to forward all investigation findings to the Office of the Attorney-General for a decisive opinion. The move concerns civil works contracts 3–4 of the Thai-Chinese high-speed rail project, covering the Lam Takhong–Sikhio and Kut Chik–Khok Kruat sections in Nakhon Ratchasima.
The contracts, under Phase 1 of the Bangkok–Nakhon Ratchasima route, are held by ITD. The review follows a crane collapse on Jan 14, when construction equipment fell onto a passing train, killing 30 people and injuring 69 others. Mr Anan said the SRT board was acting on instructions from Prime Minister Anutin Charnvirakul and Transport Minister Phiphat Ratchakitprakarn. Initial findings from the internal investigation found clear breaches of contract conditions by the contractor, he said.
“According to the report presented to the board, ITD failed to provide safety supervisors and lookout personnel during crane operations, despite trains continuing to pass through the area. This omission was deemed a serious safety violation and a clear breach of contractual obligations,” he said.
Investigators also found that a high-strength bolt (PT-Bar) securing the crane base fractured during the launching process, causing the front support to collapse and strike the train below. However, a full engineering conclusion has yet to be reached, he said.
Given the seriousness of the findings, SRT’s legal subcommittee advised that any contract termination must be handled with extreme caution, as it would constitute an administrative order.
“The case will therefore be submitted to the Attorney-General next week,” he said, adding that this is to ensure compliance with the 2017 Public Procurement and Supplies Administration Act, particularly Section 103, involving conditions for terminating a contract or an agreement.
Mr Anan acknowledged that terminating the contracts could delay the project, which is 99.5% complete. Retendering the remaining 0.5% could take up to 14 months, compared with an October 2026 completion if ITD continues.
SRT has temporarily suspended all related contracts and is expediting passenger insurance arrangements to restore public confidence, after admitting that passenger numbers have fallen since the incident.
Meanwhile, police and experts inspected crane debris at the accident site in Sikhiu district, Nakhon Ratchasima, on Thursday to determine the cause.

“ตามรายงานที่นำเสนอต่อคณะกรรมการ กรมอุตสาหกรรมและการพาณิชย์ (ITD) ไม่ได้จัดหาผู้ควบคุมความปลอดภัยและเจ้าหน้าที่สังเกตการณ์ระหว่างการใช้งานเครน แม้ว่าจะมีรถไฟวิ่งผ่านบริเวณนั้นอย่างต่อเนื่อง การละเลยนี้ถือเป็นการละเมิดความปลอดภัยอย่างร้ายแรงและเป็นการละเมิดข้อผูกพันตามสัญญาอย่างชัดเจน” เขากล่าว
